In short: your recordings stay yours. Only upload recordings you’re allowed to, and get consent from the people in them where the law requires it. Plans come with transcription hours and storage, and the owner of a folder pays for what happens in it. Machine-made transcripts and translations can be wrong.
About these terms
These terms are an agreement between you and Amity Results Inc., a company based in Alberta, Canada (“we”, “us”). They apply when you use the Amity Results website, app, API or integrations (together, “Amity Results”).
By creating an account or using Amity Results, you agree to these terms and to our Privacy Policy. If you use Amity Results for an organisation, you confirm that you’re allowed to accept these terms for it, and “you” includes that organisation.
Your account
- Give us accurate details and keep them up to date.
- Keep your password and recovery codes safe, and tell us straight away at security@amityresults.com if you think someone else has used your account. We recommend turning on two-step verification.
- Each login is for one person. Invite others to your folders instead of sharing a login.
- You must be at least 16 to use Amity Results.
You’re responsible for what happens under your account.
Early access
Amity Results is in early access. Features may change, appear or be removed while we learn what works. During early access we don’t promise any particular level of availability, and we’ll tell you before anything you rely on is removed.
Plans, hours and billing
- Plans. Each plan includes a number of transcription hours per billing period, an amount of storage and a largest file size. The current plans and prices are shown in the app on the Billing & usage page.
- Hours. Transcribing a recording uses hours equal to its length. Your plan’s hours reset at the start of each billing period; unused plan hours don’t carry over.
- Top-ups. Hours you buy as a top-up don’t expire. They’re used after your plan’s hours run out.
- The folder owner pays. Recordings processed in a folder use the folder owner’s hours, and their storage counts against the folder owner’s plan, even when a member uploaded them.
- Waiting for hours. If the folder owner doesn’t have enough hours, a new recording waits rather than failing, and starts on its own once hours are added.
- Translation is included in every plan, with a fair-use limit shown in the app.
- Paying. During early access, plans and top-ups are arranged with us by email. When online payment opens, prices will be in US dollars plus any applicable taxes, charged in advance for each month or year. You can cancel at any time and keep your plan until the end of the period you’ve paid for. Refund rules (lawyer).
- Price changes. We’ll give you at least 30 days’ notice by email before a price change affects you.
Your content
Everything you upload, and everything we create from it (transcripts, summaries, subtitles, translations, exports), is your content. You own it.
You give us permission to store, copy, process and display your content only as needed to provide Amity Results to you and to the people you share it with. This includes sending it to the providers listed on our subprocessors page. This permission ends when your content is deleted, apart from copies that disappear from backups on the schedule in our Privacy Policy.
You’re responsible for your content and for having the right to upload it.
Recording consent and acceptable use
Laws about recording people differ from place to place, and some require everyone in a conversation to agree. Before you upload a recording, make sure you have any consent the law requires from the people in it, and that you’re allowed to share it with the people you invite.
Don’t use Amity Results to:
- upload recordings made without consent the law requires, or that you otherwise have no right to use;
- upload anything illegal, including content that sexually exploits children, which we report to the authorities;
- harass, threaten or invade the privacy of others;
- infringe anyone’s copyright, trademarks or other rights;
- upload malware, or try to break, overload, probe or get around the security of Amity Results;
- access other people’s data, or scrape or copy the service;
- resell Amity Results, or share API keys outside your organisation, without our written agreement.
We may remove content or suspend accounts that break these rules.
Folders and sharing
The owner of a folder decides who can see and change what’s in it, and pays for its use. When you invite someone, they see the folder’s recordings, transcripts and notes according to the role you give them. If you leave a folder, or the owner removes you, you lose access to its content.
Machine-made results
Transcripts, speaker labels, summaries, chapters, tags and translations are produced automatically and can be wrong. Check them against the recording before relying on them for anything important, such as legal, medical or financial decisions.
API and integrations
- Keep API keys secret. Anything done with your key counts as done by you.
- Stay within the rate limits in our API documentation.
- The API is in an invitation-only beta and may change. We’ll give notice before we remove anything you use.
- When you connect another service, such as Google Drive, YouTube, Slack or Microsoft Teams, its own terms also apply. We aren’t responsible for those services.
Privacy and data processing
Our Privacy Policy explains what we do with personal information. If you’re a business that needs a data processing agreement, see our DPA page.
Availability and changes to the service
We work to keep Amity Results running and your data safe, but we can’t promise it will always be available or free of errors. We may change or stop features. If we stop offering Amity Results altogether, we’ll give you at least 30 days’ notice and a way to export your content.
Suspension and closing your account
You can close your account at any time from Profile. We may suspend or close an account that breaks these terms or puts other people or the service at risk. Where we can, we’ll warn you first and give you a chance to fix it or export your content.
When an account closes, we delete its data as described in our Privacy Policy.
Disclaimers
Apart from what these terms say, Amity Results is provided “as is”. As far as the law allows, we make no other promises, including that it’s fit for a particular purpose.
Limitation of liability
As far as the law allows, we aren’t liable for indirect or consequential losses, such as lost profits or lost data, and our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and CAD $100 (lawyer). Nothing in these terms limits liability that can’t be limited by law.
Indemnity
If someone makes a claim against us because of content you uploaded or because you broke these terms, you’ll cover our reasonable costs of dealing with it.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute will be decided by the courts of Alberta, unless the law where you live gives you the right to bring it elsewhere.
Changes to these terms
If we change these terms in a way that matters, we’ll email account owners and ask you to accept the new terms the next time you sign in. The date at the top of this page always shows the latest version.
